1. Agreement to Terms

Welcome to Quarkova (https://quarkova.com), an Indian Digital Service Platform operated as a sole proprietorship founded by Sunil Baran Mishra (MSME Udyam Registration: UDYAM-WB-12-0125801).

By accessing or using our website, web tools, digital products, software templates, services, or APIs, you agree to be bound by these Terms and Conditions and all applicable laws of India. If you do not agree to these terms, you must discontinue using our services immediately.

Quarkova reserves full rights and authority under Indian law to enforce terms and safeguard its platform:

• Account & Access Control: Suspend, restrict, or block IP addresses, accounts, or automated scripts violating these terms.
• Order & Service Cancellation: Refuse, cancel, or refund orders/services involving suspected fraudulent or prohibited behavior.
• Content Removal: Immediately delete or remove any unlawful, defamatory, or infringing user content.
• Law Enforcement Cooperation: Fully cooperate with Indian law enforcement agencies, cyber crime divisions, and judicial authorities.
• Legal Prosecution: Initiate civil claims or criminal proceedings under the Indian Information Technology (IT) Act, 2000 and the Bharatiya Nyaya Sanhita (BNS) / IPC for malicious actions.

5. Intellectual Property Rights

All original source code, design elements, graphics, site layouts, branding, logos, trademarks, and documentation on Quarkova are protected by Indian Copyright and Intellectual Property laws.

Users retain full ownership of the private documents and files processed through our tools. Quarkova claims no ownership rights over your personal files.

6. Payments, Fees & Third-Party Gateways

Payments for paid services or digital products are safely conducted through Razorpay Payment Gateway.

• All prices are stated in INR (₹) or USD ($) as indicated on billing checkout screens.
• Users agree to provide true, accurate payment information. Charges resulting from unauthorized card/account usage will be reported to payment processors and authorities.

7. Disclaimer of Warranties

The services and web tools are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. Quarkova makes no guarantees of uninterrupted access, error-free operations, or specific result metrics.

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of or in connection with Quarkova shall be subject to the exclusive jurisdiction of the competent courts in West Bengal, India.
